Terms & Conditions
Welcome to Windermere Wakesurfing. Please read these Terms and Conditions carefully before making a booking or participating in any activity. By booking or taking part, you are agreeing to these terms on behalf of yourself and your entire party.
1. Participation & Safety Disclaimer
- Every person taking part in any water sports activity provided by Windermere Wakesurfing must read and accept these terms.
- By ticking the confirmation box at the time of booking, you confirm that you understand all information and risks associated with water-based activities for yourself and your party.
- All participants must listen carefully to safety briefings and instructions before participating.
- If you do not understand the briefing or need further clarification, please ask a member of our team immediately.
- Participants must obey all instructions given by Windermere Wakesurfing staff at all times.
- Windermere Wakesurfing reserves the right to terminate any activity immediately if participants fail to follow instructions or safety rules.
Important:
- No alcohol or non-prescription drugs are to be consumed before or during any activity.
- If our team suspects you are under the influence of any altering substance, you will not be permitted to participate.
Equipment & Safety Gear:
- All protective equipment, including buoyancy aids and helmets, must be worn as instructed.
- Rented equipment remains the property of Windermere Wakesurfing and must be returned after use.
- Damage caused by misuse or negligence is the responsibility of the participant, and repair or replacement costs will be charged accordingly.
Risks:
- All participants acknowledge that water sports can be dangerous activities.
- While we take all reasonable precautions, accidents can happen.
- By participating, you accept these risks and agree to take part at your own discretion.
- Windermere Wakesurfing is not liable for personal injury, loss, or damage to property, except where caused by negligence.
Medical Conditions:
- You must inform us of any existing injuries, medical conditions, or allergies before participating (e.g., heart problems, asthma, diabetes, allergies).
- Please record this information in the ‘Additional Comments’ section of your booking form and inform our staff on the day.
Behaviour:
- Threatening or abusive behaviour towards staff or other visitors will not be tolerated and will result in removal from the site.
2. Bookings & Payments
- All bookings are subject to availability and confirmation.
- Full payment is required at the time of booking unless agreed otherwise in writing.
- Booking confirmations will be sent via email; please check your details carefully.
- Bookings can be made via our booking platform or directly through our team.
3. Refund & Cancellation Policy
Customer Cancellations:
- Cancellations made more than 7 days before the booking time will receive a full refund or option to reschedule.
- Cancellations made less than 7 days but more than 48 hours are non-refundable but will be able to reschedule.
- Cancellations made less than 48 hours are non-refundable and will not be able to reschedule.
- No-shows or late arrivals (over 15 minutes) will be treated as cancellations with no refund.
Company Cancellations:
- If we cancel due to adverse weather, equipment failure, or safety concerns, you will be offered a full refund or option to reschedule.
- We will notify you as early as possible in such cases.
Weather Policy:
- Water sports are weather-dependent. Conditions can change rapidly.
- If unsafe weather conditions prevent your session, we will offer a full refund or reschedule.
Rescheduling:
- Rescheduling is possible more than 48 hours before your booking time.
- Requests within 48 hours cannot be guaranteed and are subject to availability.
4. Late Arrivals
- Please arrive at least 15 minutes before your scheduled activity time.
- Late arrivals may result in reduced session time or cancellation without refund.
5. Liability
- By participating, you acknowledge and accept the inherent risks of water sports activities.
- Windermere Wakesurfing will not be held liable for injuries, losses, or damages, except where caused by our negligence.
- You are responsible for your own safety and that of your party.
6. Equipment Damage
- All rented equipment must be used responsibly.
- You will be liable for any damage or loss caused by misuse or negligence.
7. Photography & Media
- We may capture photos or videos during sessions for promotional purposes.
- If you do not consent to this, please inform us prior to your session.
8. Conduct
- Any threatening, abusive, or dangerous behaviour will result in immediate removal from activities and premises.
- We reserve the right to refuse service to anyone in breach of these terms.
9. Governing Law
- These Terms and Conditions are governed by the laws of England and Wales.
- Any disputes arising will be subject to the exclusive jurisdiction of the courts of England and Wales.
